What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice on October 22, 2022 for rent arrears of $2,689.09 for October 2022. The Tenant made a payment of $5,378.18 on December 16, 2022, which was not enough to void the N4 Notice as the December 2022 rent was also due.
The ruling
The tenancy is terminated unless the Tenant pays $16,656.19 by May 31, 2023 or $19,412.41 by June 30, 2023 to void the order. If the Tenant does not pay, they must vacate the unit by June 30, 2023 and pay the Landlord $12,045.34 plus daily compensation of $90.62 from May 12, 2023 until move-out.
