What happened
The Landlords applied to terminate the tenancy and evict the Tenants due to non-payment of rent and NSF charges. The Tenants owed over $30,000 in arrears by the hearing date. The Landlord, who suffers from cerebral palsy, alleged being bullied by the Tenants. The Adjudicator found the Tenants' testimony to be inconsistent and contradictory, leading to the dismissal of their request for relief from eviction.
The ruling
The tenancy is terminated effective July 5, 2025, unless the Tenants pay $33,747.69 to void the order. If the Tenants do not pay and do not move out, they are ordered to pay the Landlord $24,460.10 for arrears, fees, and NSF charges (after deposit deductions), plus daily compensation of $83.51 starting May 1, 2025.
