What happened

Landlord applied to terminate the tenancy and evict the Tenant from unit 408, claiming it was the Superintendent's Premises and the Tenant's employment as Superintendent had ended. The Tenant had moved into unit 408 without the Landlord's knowledge or consent after vacating the original Superintendent's Premises, unit 406.

The ruling

The Landlord's application is dismissed. Unit 408 is not the Superintendent's Premises, and the Tenant's occupation of it is not based on a tenancy agreement as contemplated by the Act.
