What happened
The Tenant filed a T5 application alleging that the Landlords served an N12 notice of termination for personal use in bad faith. The Tenant moved out in October 2024, but the Landlords did not move into the unit until June 2025, having lived in Singapore previously. The Tenant also alleged the notice was retaliatory due to prior disputes over rent increases and maintenance.
The ruling
The Tenant's application for an order determining bad faith was dismissed. The Landlord successfully demonstrated that the delay in occupying the unit was due to their international relocation from Singapore and a representative's error regarding the termination date, rather than a lack of intent to reside in the unit.
