What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent and persistent late payment of rent. The Landlords served valid N4 and N8 notices, but the Tenants did not void the notices by paying the arrears.

The ruling

The tenancy is terminated effective April 5, 2025. The Tenants owe the Landlords $1,153.69, which includes rent arrears, application filing fee, less the rent deposit and interest. The Tenants must also pay the Landlords $57.53 per day for use of the unit from January 8, 2025 until they vacate. If the Tenants do not pay the full amount by April 5, 2025, they will owe interest at 5% annually on the outstanding balance.
