What happened
The Landlords applied to terminate the tenancy for personal use (N12) so that Landlord 1 could occupy the basement unit with her spouse. The Tenants challenged the application, alleging that it was a retaliatory move following a fire inspection they initiated and that the Landlords had previously requested an illegal rent increase. The Board found the Landlords' intent to be genuine, noting that the N12 was served before the fire inspection and that a Fire Inspection Order actually required the unit to be converted back to a single-family dwelling.
The ruling
The tenancy is terminated effective August 31, 2025. The Landlords proved good faith intent for personal occupation. While the Tenants requested more time to find housing, the Board balanced the needs of both parties and granted an extension of the move-out date to August 31, 2025, from the original notice date of July 20, 2025.
