What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant challenged the validity of the N4 notice and the determination of the lawful rent amount.

The ruling

The Board denied the Tenant's request for review and confirmed the previous order. The Board found that the rent increases were deemed lawful under section 135.1 of the Act, as the Tenant had paid the increased rent for at least 12 consecutive months. The stay of the previous order was lifted immediately due to the substantial rent arrears.
