What happened

The Landlords applied for termination of tenancy and eviction due to significant rent arrears. The Tenants challenged the validity of the N4 notice, arguing that the Landlords improperly applied the rent deposit to a month of arrears and excluded that month from the notice. The Member found the N4 valid despite the procedural error regarding the deposit. Tenant 1 sought relief from eviction, citing mental health and relationship struggles, but her proposed repayment plan was deemed unsustainable.

The ruling

The tenancy is terminated effective October 13, 2025, unless the Tenants pay $19,786.00 to void the order. If the Tenants do not pay and do not vacate, the Landlord can enforce the eviction through the Sheriff starting October 14, 2025. The Tenants are ordered to pay $14,813.28 plus daily compensation of $92.05 from September 9, 2025, until they move out.
