What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to non-payment of rent. Tenant 1 contested the amount of arrears, claiming a verbal agreement with the Landlord's brother to waive rent following a flood and asserting that cash payments were made for which no receipts were provided. The Landlord denied any such agreements or payments, relying on a detailed ledger. The Member found the Tenants failed to provide proof of their claims and ordered the termination of the tenancy unless the arrears are paid.

The ruling

The tenancy is terminated effective November 17, 2025. To void the eviction and continue the tenancy, the Tenants must pay $16,808.50 by November 17, 2025. If the Tenants do not pay and do not move out, the Landlord can enforce the eviction through the Sheriff starting November 18, 2025. If the tenancy ends, the Tenants are ordered to pay the Landlord $10,900.25 plus daily compensation of $65.75 until they vacate.
