Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations or failed to comply with health, safety, housing or maintenance standards under the Residential Tenancies Act, 2006. The issues raised by the Tenants included a leak from the second bathroom shower/tub, issues with the dryer and ventilation, electrical outlets, fire safety systems, furnace, closet doors, and broken/cracked windows.
The ruling
The Landlord failed to meet his maintenance obligations under the Residential Tenancies Act with respect to the shower/tub leak, the dryer, and the missing window frame piece. The Landlord is ordered to pay the Tenants $2,495.14, which includes a rent abatement of $2,447.14 and $48.00 for the cost of filing the application.
