What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and damage to the rental unit. The Tenant failed to open the door for the fire department, resulting in the fire department kicking in the door and causing damage. The Landlord is seeking to recover the cost of replacing the damaged door.

The ruling

The tenancy is terminated as of June 30, 2023, the date the Tenant vacated the rental unit. The Tenant must pay the Landlord $2,618.92, which includes rent arrears and the application filing fee, minus the rent deposit and interest owed to the Tenant. The Tenant must also pay the Landlord $1,316.45 for the cost of replacing the damaged property. If the Tenant does not pay the full amount by March 8, 2024, they will owe interest at 7% annually on the outstanding balance.
