What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
The ruling
The tenancy will be terminated on April 23, 2023 unless the Tenant pays $3,104.90 to void the order and continue the tenancy. If the Tenant does not pay, the Landlord may file the order with the Sheriff to enforce the eviction. The Landlord owes the Tenant $1,774.62 for the rent deposit and interest, but the Landlord can deduct $78.90 per day for compensation starting March 31, 2023 until the Tenant moves out.
