What happened

The Tenant filed a T2 application alleging that the Landlord illegally entered the unit, changed the locks, harassed him, and failed to provide time to retrieve property while the Tenant was incarcerated. The Tenant claimed his belongings, including valuables like a gold chain and cash, were missing or disorganized in a garage. The Landlord countered that the Tenant's brother had been occupying the room, moved the belongings himself, and indicated the tenancy was ending. The Board found the evidence from both sides to be equal but opposite, meaning the Tenant failed to meet the burden of proof to support his allegations.

The ruling

The Tenant's application was dismissed in its entirety. The Board found that the Tenant did not provide sufficient evidence to corroborate his claims of illegal entry, changed locks, or harassment. Evidence suggested the Tenant's brother may have been the one to move the belongings and end the tenancy while the Tenant was incarcerated.
