What happened
The Landlord applied to terminate the tenancy after the Tenant allegedly breached a condition of a previous order regarding the payment of water utility bills. An eviction order was initially issued without a hearing. The Tenant filed a motion to set aside this order, citing confusion over the accounting of the water bills, specifically regarding payments made directly to the utility company and the absence of a specific bill during the previous hearing. The adjudicator reviewed the circumstances and the Tenant's payment history to determine if the eviction was fair.
The ruling
The LTB granted the Tenant's motion to set aside the eviction order issued on June 9, 2025. The previous order was cancelled and replaced with a new conditional order. The Tenant must pay $696.25 in three installments by October 31, 2025, and must pay all future water bills within 7 days of receiving them from the Landlord via email. If the Tenant fails to meet these conditions, the Landlord may apply for an eviction order without further notice to the Tenant.
