What happened

The Landlord applied to terminate the tenancy and evict the Tenant based on persistent late payment of rent. The Landlord served an N8 Notice following a period of 11 months where no rent was paid. The Tenant disputed the monthly rent amount but provided no evidence to support a lower figure. The Board found that total failure to pay rent for an extended period qualifies as persistent late payment under the Act.

The ruling

The tenancy is terminated effective September 7, 2025. The Tenant is ordered to pay the Landlord $3,137.06 for daily compensation and the application fee, after deducting the last month's rent deposit and interest. The Tenant must also pay $22.85 per day for stayed occupation until they move out. If the Tenant does not vacate by the deadline, the Landlord may enforce the eviction through the Sheriff.
