What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and damage to the rental unit. The Tenant did not void the N4 notice by paying the rent arrears. The Tenant was still in possession of the rental unit at the time of the hearing. The Landlord claimed the Tenant caused significant damage to the rental unit's kitchen, which the Tenant acknowledged but disputed the extent of the damage.

The ruling

The tenancy is terminated effective October 31, 2024 due to non-payment of rent and damage to the rental unit. The Tenant must pay the Landlord $25,881.53 by October 31, 2024, which includes rent arrears and the application filing fee, less the rent deposit and interest. If the Tenant does not pay by the due date, they will owe interest at 6% annually on the outstanding balance. The Landlord is not awarded any compensation for the damage as they did not provide specific repair quotes.
