What happened
The Tenant requested a review of an LTB order that terminated his tenancy for substantial interference. The Tenant argued that the hearing member erred in evaluating the Landlord's duty to accommodate his disability to the point of undue hardship under the Human Rights Code. The original order found that the Landlord had taken reasonable steps, including soundproofing doors and modifying HVAC, but that soundproofing the entire unit was an undue hardship given the costs and lack of guaranteed results.
The ruling
The review request was denied, and the original eviction order was confirmed. The Board found that the hearing member correctly applied the law regarding disability accommodation, determining that the Landlord had done enough to accommodate the Tenant without incurring undue hardship. The eviction was maintained with a delayed termination date of August 31, 2025, to allow the Tenant to find new housing with medical assistance.
