What happened
The Landlord applied to evict the Tenant for non-payment of rent from a Rent-Geared-to-Income (RGI) unit. The Board found that the Landlord made no effort to negotiate a payment plan with the Tenant. As a result, the Board denied an immediate eviction order and instead granted the Tenant relief from eviction by ordering a six-month payment plan to clear the arrears.
The ruling
The tenancy is not terminated. The Tenant is ordered to pay the Landlord a total of $1,542.00, covering rent arrears and application costs. The payment is structured over a six-month period, with the Tenant also required to pay ongoing rent in full and on time. If the Tenant defaults on this payment plan, the Landlord may apply for an eviction order without a further hearing. The decision to grant relief was based on the Landlord's failure to attempt negotiating a payment plan.
