What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to maintain the backyard of the rental unit in an acceptable state of cleanliness, which substantially interfered with the Landlord's rights, privileges and interests.

The ruling

The tenancy will continue subject to conditions on the Tenant's behaviour. The Tenant must clean up the backyard by October 7, 2024, remove all prohibited items, and keep the backyard in compliance with the tenancy agreement for 12 months. If the Tenant fails to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
