What happened
Tenant filed a T2 application alleging that the Landlord increased his rent without written notice, that the Landlord illegally collected an additional last month rent deposit and that the Landlord failed to properly address behaviour of another tenant in the residential complex that was substantially interfering with the Tenant's reasonable enjoyment. The Tenant later withdrew the substantial interference claim and the application was amended to a T1 application regarding the rent increase and illegal charges.
The ruling
The Landlord illegally increased the rent from $1,100 to $1,200 and then to $1,450 without proper notice and above the allowable guideline. The Tenant paid the illegal increases for 8 months, totaling $2,550 in excess rent. The Landlord is ordered to pay the Tenant $2,550.
