What happened

The Landlord requested a review of an order that previously awarded the Tenant $2,550.00 for illegal rent increases. The Landlord argued that the Member failed to account for the Tenant's improper notice to terminate the tenancy, which resulted in rent arrears that should have been offset against the amount owed to the Tenant.

The ruling

The review request was granted in part. The Board found that while the Landlord did collect illegal rent, the original calculation failed to account for the Tenant's short notice to terminate. The Tenant was found to owe rent for April 2024. Consequently, the original award of $2,550.00 to the Tenant was reduced to $1,450.00 after offsetting the rent arrears.
