What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant has substantially interfered with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Landlord claimed the Tenant was maintaining the rental unit in a poor condition, which prevented the Landlord's electrician from performing maintenance work and pest control from treating the unit for rodents. The Landlord also received complaints from neighbors about the condition of the unit attracting rats and the unsightly garbage in the backyard.

The ruling

The tenancy is terminated effective May 27, 2023. The Tenant must move out by this date. If the unit is not vacated by May 27, 2023, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenant must pay the Landlord $186 for the application filing fee and $12.82 per day for use of the unit starting May 1, 2023 until the Tenant moves out. If the Tenant does not pay the full amount by May 27, 2023, the Tenant will owe interest at 6% annually on the outstanding balance.
