What happened
The Landlords filed an application to evict the Tenants for non-payment of rent. During the hearing, an initial request for an interpreter by the Tenants was resolved when the Tenant's son acted as a translator. The Tenants acknowledged the accuracy of the rent arrears claimed by the Landlords. The cause for non-payment was cited as job loss, which made a repayment plan unviable as their current income barely covers the monthly rent. The Landlords stated the arrears caused them financial hardship, forcing them to use investment funds to cover their mortgage.
The ruling
The tenancy is conditionally terminated. The Tenants can void the order by paying the Landlords $11,686.00 by May 31, 2025. If they fail to do so, they must vacate the unit by May 31, 2025. If the tenancy is terminated, the Tenants are ordered to pay the Landlords $6,449.62, which accounts for rent arrears, the application fee, and deducts the rent deposit and its interest. Additionally, they will owe a daily compensation of $98.63 for each day they occupy the unit after May 6, 2025.
