What happened
The Landlord applied for an order requiring the Former Tenant to pay out-of-pocket costs resulting from the Former Tenant's failure to pay utility costs as required by the tenancy agreement. The application was dismissed because the Landlord failed to prove proper service of the Notice of Hearing and Application to the Former Tenant.
The ruling
The Landlord's application for utility costs against the Former Tenant was dismissed. The Board found that the Landlord did not satisfy the requirements for serving a former tenant by email because there was no proof (such as a read receipt or reply) that the Former Tenant actually saw the hearing notice. Because the Landlord did not know the Former Tenant's current whereabouts, an adjournment was not granted.
