What happened

The Landlord had previously obtained an order (LTB-L-105488-24) to evict the Tenants for personal use. On April 25, 2025, the Tenants requested a review of that eviction order, alleging serious errors. They claimed their cross-examination of the Landlord was unfairly curtailed, the Board wrongly found the Landlord credible, and the Board made a legal error by not granting them relief from eviction under section 83 of the RTA. This review order addresses and ultimately denies the Tenants' request.

The ruling

The Tenants' request to review the eviction order LTB-L-105488-24 is denied. The adjudicator found no serious errors in the original hearing concerning procedural fairness (cross-examination), credibility findings, or the application of the law regarding relief from eviction. The original eviction order is confirmed and remains unchanged.
