What happened
The Tenant filed a combined T2 and T6 application following a flood in the rental unit on March 2, 2024. The Tenant alleged that the Landlord harassed her to vacate and that the lack of flooring after the flood interfered with her enjoyment of the unit. Furthermore, the Tenant claimed significant plumbing issues (sink, tub, and toilet backups) that the Landlord failed to repair. The Landlord argued that the flooring was not replaced because the Tenant refused to vacate for one week to allow for installation and denied the contractors entry for plumbing repairs.
The ruling
The Landlord is ordered to pay the Tenant $458.10 by December 5, 2025. This includes $410.10 for a rent abatement due to plumbing issues and $48.00 for the filing fee. The Tenant's claims regarding harassment and interference due to flooring issues were dismissed because the Landlord attempted to repair the floors, but the Tenant would not vacate for the necessary time.
