What happened
The Landlord filed applications for non-payment of rent and for personal use. The Tenants did not attend the hearing. Before the hearing, the Landlord inspected the unit and discovered it had been abandoned, with personal belongings removed and utilities disconnected. The Tenants did not inform the Landlord they were leaving or return the keys. The tenancy was deemed terminated on the date the Landlord discovered the abandonment. The application for personal use was dismissed as moot.
The ruling
The tenancy is terminated effective June 3, 2025, the date the Tenants were found to have abandoned the rental unit. The Tenants are ordered to pay the Landlord a total of $17,403.87, which includes rent arrears up to the move-out date and the application filing fee. Interest at 5% per annum will be charged on any outstanding balance starting from June 24, 2025.
