What happened
The Landlord applied for eviction based on an N11 agreement to terminate signed by the Tenant. An initial order was issued without a hearing, which the Tenant moved to set aside. The Tenant claimed he never signed the N11 and argued there were three tenants rather than one. The Tenant also admitted to intentionally withholding rent due to a dispute over utilities.
The ruling
The Tenant's motion to set aside the eviction order was denied. The LTB found that the Tenant had signed a valid agreement to terminate the tenancy and was significantly in arrears. The stay of the previous eviction order was lifted effective August 31, 2025.
