What happened
The Landlord filed an application to terminate the tenancy for persistent late payment of rent (N8). An initial order was issued, which the Tenant successfully requested to be reviewed. The re-hearing confirmed the Tenant's history of persistent late payments, both before and after the N8 notice was served. The Tenant admitted to the late payments, attributing them to dissatisfaction with unresolved kitchen maintenance issues, for which he never filed a formal application. The Tenant also disclosed he was unemployed and could no longer afford the rent. The Board ultimately ordered the termination of the tenancy.
The ruling
The tenancy is terminated effective July 31, 2025, due to persistent late payment of rent. The Tenant must vacate by this date. The Tenant is ordered to pay the Landlord $1,715.10, representing compensation for use of the unit and the application fee, minus the rent deposit and accrued interest. Despite finding the tenancy unsustainable, the Board granted the Tenant relief under section 83(1)(b) by postponing the eviction to July 31, 2025, to allow him time to find new housing.
