What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on July 31, 2023 unless the tenants pay $525.80 by June 30, 2023 or $2,137.10 by July 31, 2023 to void the order. The landlord is entitled to daily compensation of $52.97 for the tenant's continued occupation after June 8, 2023. The landlord owes the tenants $2,313.05 for the rent deposit and interest, which can be deducted from the daily compensation.
