What happened

The Tenant applied for an order determining that the Landlords substantially interfered with her reasonable enjoyment and harassed or threatened her. The Tenant alleged that cigarette smoke from other units was entering her rental unit and that the Landlords failed to enforce the smoke-free policy of the residential complex. The Landlords contended that they took reasonable steps, including serving notices to other tenants when complaints were received.

The ruling

The Tenant's application was dismissed in its entirety. The Adjudicator found that the Tenant did not provide sufficient evidence or specific details to support the claims of harassment or substantial interference. Conversely, the Landlord demonstrated that reasonable steps were taken to address previous smoking complaints by issuing legal notices to the responsible parties.
