What happened
Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The Tenants claimed they had a verbal agreement with the Landlord to reimburse them for repairs they made to the rental unit.
The ruling
The Tenants' application is dismissed. The Tenants have not proved on a balance of probabilities that the Landlord failed to meet the Landlord's maintenance obligations under the Act. The Landlord responded reasonably to the maintenance issues, and the Tenants did not mitigate their losses by returning the drawer assembly they purchased without the Landlord's consent.
