What happened
The Landlords applied to enforce an eviction after the Tenants breached a prior consent order regarding rent arrears. The LTB had issued an eviction order on March 11, 2025. The Tenants filed a motion to set aside this eviction order, which was heard on May 22, 2025. The Board denied the motion, finding it would be unfair to the Landlords to set aside the eviction due to the Tenants' worsening financial situation and rent arrears that had doubled to over $13,000.
The ruling
The Tenants' motion to set aside an eviction order is denied. The Tenants had previously breached a consent order for rent payment, and their arrears had since doubled to $13,136.00. The Board found it would be unfair to the Landlords to cancel the eviction. The stay on the eviction order is lifted effective June 30, 2025, to give the Tenants an opportunity to find alternative accommodation.
