What happened

Tenant applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The Tenant testified that the rental unit was an illegal unit that did not meet the requirements of the Fire Code, and that the Landlord knew about this but did not take any steps to correct the issues.

The ruling

The Landlord must pay the Tenant $1,800.00 as an abatement of rent for the period of his occupation of the rental unit, and a further amount of $2,000.00 as general damages, plus the costs of this application, $53.00, totalling $3,853.00.
