What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The N4 notice was found to be defective, so termination of the tenancy will not be considered. The Landlord's L1 application can be considered for rent arrears only. The Tenants are ordered to pay $18,056 to the Landlord, which includes $17,870 in rent arrears and $186 in application fees.
