What happened
The Tenant requested a review of an order for non-payment of rent that was issued in their absence. The Tenant initially claimed they were not reasonably able to participate in the original hearing but later withdrew this reason. They then argued that the original order contained a serious error because they had already vacated the unit before the Landlord filed the application. The Board denied the review request, finding no serious error. It was determined that the original Member's decision was reasonable based on the evidence available at the time, and the Tenant's failure to attend and present their evidence was their own choice. The original order was confirmed.
The ruling
The Tenant's request to review a previous order (LTB-L-098347-24) is denied. The Board found no serious error in the original proceeding or order. The interim order staying the original order is cancelled. The original order is confirmed and remains unchanged. The tenancy is terminated effective May 27, 2025, as possession has been returned to the Landlord.
