What happened
The Landlord applied for an order to terminate the tenancy due to significant rent arrears. The Landlord's representative claimed this was the second such application and that the Tenant's non-payment was a deliberate attempt to cause financial harm. The Tenant acknowledged the debt but cited her community connections and the hardship of moving, requesting a delayed eviction. The Board granted the eviction but postponed the enforcement date to allow the Tenant time to pay the arrears or find new accommodation.
The ruling
The tenancy is terminated unless the Tenant pays $14,557.68 by June 30, 2025. If payment is not made, the Tenant must vacate by that date and pay the Landlord $10,592.21, plus daily compensation of $59.42 from May 27, 2025. The Board delayed the eviction to mitigate the impact on the Tenant, despite the financial prejudice to the Landlord.
