What happened
The Tenant requested a review of a previous order (LTB-L-060412-25) which had ordered the payment of rent arrears and a filing fee. The Tenant argued that they were unable to participate in the original hearing because they had to work. The Tenant also contested the amount of arrears, claiming they vacated earlier than noted and that the rent deposit covered all outstanding rent.
The ruling
The Tenant's request for a review of the order dated October 20, 2025, is denied. The original order, which determined that the Tenant owed the Landlord for the application filing fee after pro-rating rent arrears against the deposit, remains in full force. The Member concluded that missing a hearing for a work shift is a choice, not an external barrier to participation, and no serious error in the financial calculations was demonstrated.
