What happened

Tenants applied for an order determining the Landlord failed to meet maintenance obligations regarding water leaks and mould. Tenants discovered leaks and mould in the bedroom, garage, and basement upon moving in. Despite several repair attempts, including foundation work and weeping tile replacement, the issues persisted for several months, rendering a significant portion of the basement unusable.

The ruling

The Landlord is ordered to pay the Tenants $3,798.00, which includes a rent abatement of $3,750.00 for maintenance failures between March and July 2023, plus the $48.00 filing fee. The Landlord must pay this amount by December 14, 2025, or simple interest will begin to accrue.
