The ruling
The Tenants' applications were dismissed as they did not prove the allegations on a balance of probabilities. The Landlord was responsive to the Tenants' complaints about mice and took reasonable steps to address the pest control issue. The Tenants vacated the unit before the issue was fully resolved, and the Landlord was entitled to rent for 3 months after the Tenants vacated. The Tenants were not entitled to a refund of the $6,300 prepaid rent.
