What happened
The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant requested an adjournment to combine the hearing with a pending maintenance (T6) and tenant rights (T2) application, claiming the Landlord reneged on a rent forgiveness agreement related to maintenance issues. The Member denied the adjournment. The Tenant vacated the property in May 2025 after the power was disconnected by the Electrical Safety Authority.
The ruling
The tenancy was terminated effective May 8, 2025, the date the Tenant vacated the unit. The Tenant is ordered to pay the Landlord $7,885.68, which accounts for rent arrears and the filing fee, offset by the last month's rent deposit and accrued interest. Interest on the balance begins if not paid by September 1, 2025.
