What happened

Tenant applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served the Tenant an N12 notice of termination on May 3, 2023 for the purpose of residential occupation by the Landlord's son. The Tenant vacated the rental unit on June 18, 2023, but the rental unit was listed for rent on MLS in August 2023 and rented out for a higher monthly rent.

The Tenant proved the Landlord served the N12 notice in bad faith. The Landlord is ordered to pay the Tenant $9,054.36 for the increased rent and $1,409.50 for moving expenses, plus the application filing fee.
