What happened

The Landlord applied for eviction due to non-payment of rent. A previous order was issued, but the Tenant requested a review, claiming technical difficulties prevented participation. The review was granted, the original order was cancelled, but the Member ultimately determined the tenancy was no longer viable due to massive arrears exceeding $30,000 and the Tenant's inability to pay ongoing rent.

The ruling

The LTB granted the Tenant's request for review and cancelled the previous order. However, upon reviewing the merits, the Member ordered the tenancy terminated effective September 28, 2025. The Tenant must pay $26,055.33 to the Landlord to cover arrears and filing fees after deducting the rent deposit and interest. The Tenant may void the eviction by paying $30,186.00 on or before September 28, 2025.
