What happened
Landlord applied for an order to terminate the tenancy and evict the Tenants due to the Tenants' failure to meet certain conditions specified in a previous LTB order. The Landlord alleged that the Tenants engaged in disruptive and disorderly behavior on multiple occasions, including forcibly knocking on another unit's door, yelling in their unit and in the hallway, and a guest of the Tenants being observed stealing items from cars in the residential complex.
The ruling
The tenancy between the Landlord and Tenants is terminated, and the Tenants must vacate the rental unit by May 12, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The amount of the rent deposit and interest owed to the Tenants exceeds the compensation owed to the Landlord, but the Landlord is authorized to deduct $29.84 per day from the amount owed to the Tenants for the Tenants' continued occupation of the unit after May 2, 2023.
