What happened

The Landlords applied for an order to terminate the tenancy and evict the Tenant, claiming they required the unit for residential occupation by the Landlords' child for at least one year. The application was based on an N12 notice served to the Tenant. However, the notice was found to be legally defective regarding the termination date.

The ruling

The Landlords' application to terminate the tenancy for personal use was dismissed. The LTB found that the N12 notice served was defective because it specified a termination date that did not align with the last day of the rental period, failing to comply with the mandatory requirements of the Residential Tenancies Act.
