What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's behavior and conduct that resulted in the serious impairment and safety of other tenants in the residential complex. The Landlord claims the Tenant left a burning tea light candle unattended in the rental unit, which caused a fire and significant damage. The Landlord also claims the Tenant continued to engage in behavior that seriously impaired the safety of other residents after the initial fire incident.

The ruling

The Landlord's application is granted. The tenancy is terminated, and the Tenant must vacate the rental unit by April 2, 2024. The Tenant must pay the Landlord $5,169.62, which includes compensation for use and occupation of the unit and the application filing fee. If the Tenant does not pay the full amount by April 2, 2024, the Tenant will owe interest at 7% annually on the outstanding balance.
