What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenants did not void the notices by paying the arrears. The Tenants were in possession of the rental unit on the application date.
The ruling
Unless the Tenants void the order by paying $14,249.47 by January 31, 2024, the tenancy will be terminated. If the Tenants do not void the order, they must pay the Landlord $6,907.53, which includes rent arrears and the application filing fee, minus the rent deposit and interest. The Tenants must also pay daily compensation of $79.68 from December 1, 2023 until they move out.
