What happened
Tenants filed a T6 application for maintenance issues. The case has a long history, starting in 2019. After a previous member left the LTB, a de novo hearing was scheduled. The tenants, with new legal counsel, were allowed to amend their application. However, the adjudicator found the amended application lacked specific details about the maintenance claims, containing only a narrative history. The tenants' representative also failed to serve the extensive disclosure on the landlords by the deadline. Due to the lack of detail and procedural issues, the adjudicator dismissed the application as it was procedurally unfair to proceed.
The ruling
The Tenants' T6 application regarding maintenance issues was dismissed. Despite being granted an amendment, the adjudicator found the application lacked the necessary specific details of the alleged maintenance problems, containing mostly a narrative history. Furthermore, the Tenants' legal representative failed to serve disclosure on time. The adjudicator concluded it would be procedurally unfair to proceed, and therefore, the application could not be adjudicated on its merits.
