What happened
The Tenant applied for an order determining that the Landlords failed to meet maintenance obligations regarding a cockroach infestation. The Tenant discovered cockroaches in October 2022 and notified the Landlord's handyman, but no action was taken for two weeks until the town's by-law department intervened. The Landlord subsequently attempted a partial treatment of the building, which the Tenant alleged was ineffective. The Tenant eventually moved out in March 2023 due to the stress of the infestation and the loss of personal property.
The ruling
The Landlords are ordered to pay the Tenant $2,828.26 by July 25, 2025. This total includes $666.10 for a 30% rent abatement for two months, $1,500.00 to replace a mattress, microwave, and deep fryer infested with cockroaches, and $662.16 for out-of-pocket moving and pest control expenses.
