What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.

The ruling

The Landlord's application is dismissed because the Landlord failed to comply with subsection 71.1(3) of the Residential Tenancies Act, 2006 by not properly declaring all prior N12 notices served on the Tenants in the application. The Tenants are ordered to repay the Landlord the $2,630 compensation they were paid within 30 days, or they will start owing interest.
